Access to Information Policy

Outlines Council’s principles regarding public access to information and the processing of requests for such access. This policy is to be read in conjunction with the Access to Information Guidelines, relevant legislation and Manly Council’s related procedures.

Application for Access to Information

This form is used to view public documents (under section 12 of the Local Government Act) and requests generally take 10 working days to process.  Information will be available to view, with the exception of any confidential material or legal documents.  Council will contact the applicant to arrange for viewing. Viewing times are 11am-5pm, Monday to Friday and files must be examined within 10 working days of Council's notification to the applicant. If files are not viewed during this time then a new application must be lodged. There is a fee for any photocopying required.

Application for Amendment of Personal Records under Freedom of Information (FOI)

The FOI Act gives people the right to require the amendment of personal information in documents held by agencies.  This right exists to ensure that personal information that may be used by an agency, ie Council, does not unfairly harm the person referred to, does not misrepresent facts about him or her, and does not give a misleading impression.

Application for Freedom of Information (FOI)

This application is used when wanting to view documents that are held in Council and are not classified as public documents. This application can take up to 21 days to process.

A $30 payment is required at the time of lodgement. If the information you require access to is your personal information this fee covers the first twenty (20) hours of processing time. If it is NOT your personal information then there is an additional fee which covers the first one (1) hour of processing.  Additional processing time will be charged to you at the rate of $30 per hour, or on a pro-rata basis for part thereof and will be required to be paid prior to the release of the documents.

Application for Internal Review FOI

Freedom of Information applicants who have their application refused, only partly granted or are unhappy with the fee charged, can seek an internal review of the decision.  The Application for Internal Review of Determination under the Freedom of Information Act (NSW) 1989 is used to request this internal review.  For more information on internal reviews refer to Council's Access to Information Guidleines and Policy and relevant legisation.
