Exceptions to Development Standards
SEPP 1 and Clause 4.6 of the Manly LEP 2013
Manly Council keeps a register of all development applications that have been determined with one or more variations to Council’s development standards. Development standards are set out in environmental planning instruments including the Manly LEP 2013 and corresponding maps (e.g. height of buildings, floor space ratios, etc).
Making this register publically available is a requirement set out by NSW Department of Planning and Environment.
Prior to the adoption of Clause 4.6 of the Manly LEP 2013, variations to development standards were known as 'SEPP 1 objections' under the State Environment Planning Policy No.1 – Development Standards (SEPP 1). The SEPP no longer applies in the Manly LEP 2013.
Developments that intend to vary or not meet certain development standards must ensure they satisfy the requirements set out in Clause 4.6 – Exceptions to Development Standards, of the Manly LEP 2013.
